POLICY OF REGISTRATION OF DOMAIN NAMES

In the area of hierarchic names of the national segment of Internet network

(top level domain BY)

1. Registration of domain names in the area of hierarchic names of the national segment of Internet network (top level domain BY) is performed on the principles of equality and non-discrimination towards any applicant who turned for registration of a domain name.
Registration of domain names is done for applicants who are persons, entrepreneurs or legal entities of any form of property located or residing both on the territory of the Republic of Belarus and abroad. All the applicants are to enjoy equal conditions and opportunities to register domain names.

2. The order of registration of domain names is defined by the Instruction on the order of registration of domain names in the area of hierarchic names of the national segment of Internet network, approved by the Administrator of the domain zone.

3. The Technical Administrator is defined by the Administrator of the domain zone based on results of tender procedure to be held in accordance with the Order on the Procedure of Tenders to define the Technical Administrator of the national domain zone.

4. The Technical Administrator provides for functioning of the national information system of domain names in the national domain zone (WHOIS Service) and provides free access to this service.
The Technical Administrator and the registrars of domain names guarantee confidentiality of the personal data of applicants – physical persons who expressed their desire to limit access to such personal data in accordance with the Law of the Republic of Belarus.

5. Domain names containing words or phrases not corresponding to common moral and ethical norms, leading to national hatred, promoting violence, cruelty and other activities forbidden by the Law of the Republic of Belarus may not be registered.

6. The applicants are recommended to avoid selecting names coinciding with the names of widely known trademarks, brands or organizations.
According to p. 1 Art. 20 of the Law of the Republic of Belarus On Trademarks and Brands the owner of a trademark (brand) or a persons who is vested the rights of use such trademark (brand) by a license contract has right to use such name in the global Internet network (including the domain name).

7. Arguments about the registration of domain names in the area of hierarchic names of the national segment of Internet network as well as arguments concerning violation of royalty right on industrial and service objects (company names, trademarks, brands) during the registration of domain names are to be reviewed by the courts in accordance with the jurisdiction defined by acting Law.
